Welcome to Stagedly, a web-based AI service provided by our company based in Austria (referred to as "Stagedly", "we", "us", or "our"). These Terms of Service (the "Terms") govern your access to and use of Stagedly's website, products, and services (collectively, the "Service").

By creating an account or using our Service in any manner, you acknowledge that you have read, understood, and agreed to be bound by these Terms, including the Privacy Policy outlined below. If you do not agree with these Terms or the Privacy Policy, you must not use the Service.

Stagedly is an AI-powered digital staging platform for interior property images. Our Service allows users (such as real estate professionals, property owners, and photographers) to upload photos of indoor rooms and quickly transform them by either adding realistic virtual furniture to empty spaces or removing existing furniture/objects.

The goal is to help visualize properties in a clean and inviting way for sale or rent without the cost or effort of physical staging. Users can select style templates and preferences for staging, or use a removal tool to clear out items from a room image. Stagedly will then generate a digitally staged or cleaned-up version of the photo and deliver the result to the user's account gallery.

We strive to provide a reliable and accessible Service, but no guarantee is made that the Service will be uninterrupted or error-free at all times. The Service and all information on our site are provided on an "AS IS" and "AS AVAILABLE" basis without any warranty of any kind. By using the Service, you acknowledge the inherent limitations of AI image generation.

Account Creation

To access certain features of Stagedly, you must create a user account. When registering, you agree to provide true, accurate, current, and complete information about yourself and to update this information promptly if it changes. You must choose a secure password for your account and keep your login credentials confidential.

Account Security

You agree to maintain the security of your account by not sharing your username or password with others and by restricting access to your account. Stagedly will not be liable for any loss or damage arising from your failure to safeguard your credentials. If our technical team suspects misuse of an account, we reserve the right to temporarily suspend or terminate the account to preserve security.

Account Use

You must not use anyone else's account or allow others to use your account without permission. You may not create multiple accounts for the same individual or create an account on behalf of someone else without proper authorization. You are responsible for all content or data uploaded or generated under your account and for all charges incurred by your account.

By using Stagedly, you make the following representations and warranties about yourself:

  Age Requirement: You are at least 18 years old, or if younger, you meet the minimum age of digital consent in your country and have the permission of a parent or legal guardian.

  Personal Use: You will use the Service for your personal or internal business use only, and not on behalf of any unauthorized third party.

  No Prohibited Content: You agree not to upload, create, or share any content that is illegal, harmful, or violates these Terms.

Free and Paid Services

Stagedly may offer certain features or limited use of the Service for free (for example, a free trial allowing a small number of watermarked images). Beyond the free tier, continued use of the Service requires payment. We provide various paid options, such as pay-per-image credits and subscription plans. All fees are stated in the indicated currency and are exclusive of taxes unless otherwise noted.

Payment Processing

We use a third-party payment processor (currently Stripe) to handle payments. The processing of payments is subject to the terms, conditions, and privacy policies of the Payment Processor, not Stagedly. We do not collect or store full credit card numbers or bank account details on our own servers.

Automatic Renewal

If you enroll in a subscription, you acknowledge that it has recurring payment features and you accept responsibility for all recurring charges until you cancel. Your subscription will automatically renew at the end of each billing cycle unless you cancel it or we terminate it.

You agree NOT to misuse the Stagedly Service or use it in any way that violates these Terms or any laws. The following is a non-exhaustive list of prohibited activities:

Your Content

Stagedly allows you to upload, create, or generate content as part of using our Service. This includes original photos, preferences, AI-generated output images, and any other material you submit. You retain ownership of all intellectual property rights in the User Content that you upload or create. We do not claim ownership over your original images or the final images produced for you.

Your Responsibilities

By uploading content, you represent and warrant that: (a) you own the content or have all necessary rights; (b) the content does not infringe any third-party rights; and (c) the content complies with these Terms and applicable laws.

License to Stagedly

By uploading content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, and display your User Content solely for providing the Service to you and operating/improving the Service.

Our Intellectual Property

The Service (including all content, materials, software, algorithms, and technology) is owned by or licensed to Stagedly and is protected by intellectual property laws. Stagedly grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business use while you are in compliance with these Terms.

You must not: copy, reproduce, or distribute any part of the Service; modify or make derivative works based on Stagedly Content; remove any proprietary notices; or use our trademarks without written permission.

Your Intellectual Property

You retain ownership of your original photos and the results generated for you. We only claim rights in the limited ways described to provide the Service.

Stagedly may integrate with or provide links to third-party services as part of our offering (for example, Stripe for payment processing). These third-party services are outside of our control and have their own terms and privacy policies. When you access third-party services through Stagedly, you do so at your own risk.

We provide these integrations for convenience but do not endorse or assume responsibility for any third-party sites, materials, products, or services. Any dealings you have with third parties are solely between you and that third party.

We reserve the right to manage the Service to ensure proper functioning and protect our rights. Our management rights include:

• • Removing or disabling content that violates these Terms
• • Suspending or limiting access to the Service
• • Implementing technical and security measures

While we endeavor to keep Stagedly running smoothly, there could be occasions where the Service is unavailable for maintenance or due to technical issues. We will make reasonable efforts to inform users of major updates or maintenance windows.

Your use of the Service is also governed by our Privacy Policy, which is part of these Terms. The Privacy Policy explains what information we collect from you, how we use and protect it, and your rights regarding your personal data. By using Stagedly, you consent to our collection and use of information as outlined in the Privacy Policy.

Stagedly respects intellectual property rights. If you believe that any content infringes your copyright, please notify us in writing with:

Send notices to the contact address provided in the "Contact Us" section. We may also notify the user and, for repeat offenders, terminate their account.

Termination by You

You may stop using the Service at any time. You may also delete your Stagedly account through account settings or by contacting support. Simply uninstalling an app or ceasing to log in does not automatically terminate recurring subscriptions.

Termination by Us

We may suspend or terminate your access at our sole discretion, with or without notice, including if you have breached these Terms, pose a security risk, or engage in fraudulent use. In serious cases, we may terminate immediately without prior notice.

Effects of Termination

Upon termination, your right to access the Service ceases immediately. We may delete your User Content and data. It is your responsibility to back up any content before termination. You are not entitled to refunds of unused fees if terminated for breach of these Terms.

Stagedly may revise or update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website. Changes will become effective no sooner than 14 days after posting, except for new features or legal changes which may be effective immediately.

By continuing to use the Service after revised Terms take effect, you indicate your acceptance. If you do not agree, you must stop using the Service before the changes become effective.

We make no warranty that the Service will meet your requirements, be uninterrupted, secure, or error-free. While we strive for high-quality outputs, the AI-generated images may contain inaccuracies or artifacts. We do not guarantee any specific outcomes from using staged images.

To the fullest extent permitted by law, Stagedly will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or other intangible losses arising from your use of the Service.

Stagedly will not be liable for data loss, service interruptions, third-party conduct, use of outputs, financial loss from decisions made using staged images, or events beyond our control.

You agree to indemnify, defend, and hold harmless Stagedly and its affiliates from any claims, liabilities, damages, losses, and expenses arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or any law; (c) your infringement of any third-party rights; or (d) any misrepresentation made by you.

This includes claims by third parties that your uploaded or generated images violate their rights. We reserve the right to assume the exclusive defense of any matter subject to indemnification by you.

We care about the integrity and safety of your data. However, you are ultimately responsible for maintaining backups of your content. While we perform routine backups for disaster recovery, we do not guarantee that your data can be recovered in the event of loss or corruption.

You agree that Stagedly shall not be liable for any loss, destruction, alteration, or corruption of data. Please download and save any important images or data that you process through Stagedly.

When you use Stagedly or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically, and you agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

You acknowledge that by clicking "I Agree" or using the Service, you are executing a legally binding agreement electronically and consent to the use of electronic signatures and records.

If you are a California resident, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by telephone at (800) 952-5210 to resolve a complaint.
